Furthermore to a groundbreaking supreme court ruling dated 15th January 2015 – the highest civil court in Spain – on Timeshare in Spain, where a claimant was successful in having their claim cancelled and having their timeshare contract refunded. A new doctrine was adopted and passed down to all the courts in Spain.
A series of decisions made in this ruling declared timeshare contracts entered after 5th January 1999 to be ILLEGAL and can be declared Null and Void if they met certain criteria. This means that any timeshare owner that has bought a timeshare after January 1999 or updated an existing timeshare since that date, can potentially make a claim if they meet any one of the following criteria as set out in the ruling:
A contract sold in perpetuity (considered anything longer than 50 years)
Contracts lacking in object, as provided by law 42/98 as well as 4/12 (applicable to any contracts sold as floating weeks)
Contracts sold where payment was made within the first 3 months from when the contract was signed – Additionally, in this instance, a claim can be made for double the amount paid within 3 months.
